20 year old giving a 23 year old a ride with unopened alcohol?

A friend of mine, who is 20 years old was giving his 23 year old friend a ride to a friends house. on the way the 23 year old asked my friend to stop at the liquor store to grab some beer. they got pulled over and the cop took the alcohol and summons them to court for alcohol in a minors possesion. if my friend wasnt drinking and theres no proof he was drinking nor the alcohol was his what will happen?
